Website Terms of Use

1. General provisions

These Website Terms of Use (the «Terms») define the conditions for using the website www.hrustata.com (the «Website»), as well as the rights and obligations of users and of the Website operator.

By using the Website, the user confirms that they have read the Terms, fully agree with them and undertake to comply with them. If the user does not agree with the Terms, they must stop using the Website.

2. Terms and definitions

• Website — the website at www.hrustata.com with all its pages and services;
• Website Operator — the person ensuring the operation of the Website;
• Seller — the business entity selling goods through the Website on the basis of the Public Offer Agreement;
• User — any person visiting the Website and/or placing an order;
• Goods — the products presented on the Website for ordering.

3. Website Operator

The owner and operator of the Website (the marketplace) is:

Goods are sold directly by the Seller, whose details are set out in the Public Offer Agreement. The purchase agreement is concluded between the User (Buyer) and the Seller on the terms of the offer.

4. Conditions of using the Website

Registration is not required to browse the Website. To place an order, the user provides the data necessary for processing and delivering the order (see the Privacy Policy).

The user undertakes to provide accurate information and not to use the Website in any way that violates the laws of Ukraine or the rights of third parties.

5. Order placement procedure

• the user selects goods and adds them to the cart;
• places an order specifying contact details and delivery method;
• the order is confirmed by a manager by phone or messenger;
• after confirmation, an invoice for payment is issued.

6. Prices and payment

Prices for goods are indicated on the Website in Ukrainian hryvnia. The Operator and the Seller reserve the right to change prices; the final price is fixed in the invoice.

7. Delivery

Goods are delivered by delivery services (Nova Poshta, Ukrposhta and others) on the terms agreed during order confirmation. Delivery times and costs depend on the selected service and the region.

8. Returns and exchange

Return and exchange of goods of proper and improper quality are carried out in accordance with the Law of Ukraine «On Consumer Rights Protection» and the terms of the Offer Agreement.

• goods of proper quality may be returned within 14 days provided their merchantable condition is preserved;
• goods of improper quality are replaced or refunded at the consumer’s request;
• food products of proper quality are non-returnable if the storage conditions or the integrity of the packaging have been breached.

9. Intellectual property rights

All materials of the Website (texts, images, logos, design, structure) are objects of intellectual property rights and are protected by the laws of Ukraine. Use of the materials without the written permission of the rights holder is prohibited.

10. Acceptable use rules

The user is prohibited from:

• interfering with the operation of the Website, compromising its security or integrity;
• using automated tools for data collection (scraping) without permission;
• posting false information, spam or malicious code;
• using the Website for actions contrary to the laws of Ukraine.

11. Liability of the parties

The Website is provided «as is». The Operator makes every effort to ensure uninterrupted operation of the Website but does not guarantee the absence of technical failures. The Operator is not liable for damage caused by using the Website in a manner contrary to these Terms or to the law.

12. Personal data processing

Users’ personal data is processed in accordance with the Privacy Policy and the Cookie Policy published on the Website.

13. Dispute resolution

All disputes are resolved through negotiations. If no agreement is reached, the dispute is considered in accordance with the procedure established by the laws of Ukraine.

14. Amendments to the Terms

The Operator reserves the right to amend these Terms. The current version is always published on the Website. Continued use of the Website after amendments means acceptance of the updated version.
